The following Terms and Conditions of Sale (hereinafter “T&Cs”) are intended to govern any order for an individual Ticket to access the Hack in Paris event (hereinafter the “Event”) placed by an individual or a legal entity (hereinafter the “Client(s)”) on the website https://www.hackinparis.com/ (hereinafter the “Site”), run by Sysdream, a French Société par actions simplifiée (French simplified joint stock company), with a capital of €267,720, having its registered office at 14 Place Marie-Jeanne Bassot – F-92300 LEVALLOIS-PERRET, registered in the Nanterre Trade and Companies Register (RCS) with the number 451 676 126 (hereinafter the “Company”).

In the event of non-compliance by the Client with the obligations subscribed to under the terms of T&Cs, Sysdream reserves the right to refuse the Client its access or interrupt his participation in the Event. In addition, fraud, attempted fraud, or the resale of Tickets may result in legal action. Sysdream reserves the right to refuse any order from a Client with whom there is such a dispute.

Before ordering any training, Clients are required to take note of the pre-requisites displayed on the Site, in order to ensure his ability to follow the chosen training.

 

ARTICLE 1 – DEFINITIONS

The terms used in these T&Cs shall have the meanings set forth below:

« Client » means any natural person or legal entity that places the order.

« Event » means the annual international event “Hack in Paris” organized by Sysdream and related to the topic of cybersecurity. The Event consists of 3 days of training followed by 2 days of conferences and workshop.

« Holder » means the person whose name appears on the Ticket.

« Site » means the website https://www.hackinparis.com/ edited by Sysdream.

« Tickets » means the credentials for accessing the Event. Several types of Tickets can be ordered:

–        A Ticket providing access to the conferences, workshops and challenges given during Event.

–        A Ticket providing access to training course, depending on the Client’s choice.

–        A Ticket giving access to the Event’s conferences, workshops and challenges given during the Event and to a training session according to the Client’s choice.

 « Venue » means the place where the Event will take place.

 

ARTICLE 2 – Ticket prices

2.1 Ticket prices

The Site offers various Ticket prices. The price will depend on the services concerned, and on the status of the person for whom the Ticket is intended.

The prices displayed include, as the case may be and depending on the services selected by the Client, the price of the course and/or the conferences and/or the workshops and/or the challenges, the course materials, the lunches and three (3) coffee breaks per day, as well as an entry to attend the evening of the Event (included only when the ticket purchased concerns the conferences, workshops and challenges). 

The total amount at the time of the validation of the order on the Site is the final amount, all taxes and fees included. This amount is included in the order confirmation e-mail and on the invoice.

The prices and the total amount of the order are given in euros. The prices guaranteed to the Client are those indicated on the Client’s order confirmation.

2.2 Conditions for obtaining reduced rate Tickets

Students and the unemployed benefit from a reduced rate for Tickets. To obtain the reduced rate it is necessary however to provide proof of status (student card or valid Pôle Emploi [Unemployment Benefits] certificate), which must be filed on the platform provided for this purpose on the Site during the validation of the order by the Client. The filed document will be reviewed by Sysdream within a maximum of ten (10) working days. Failure to comply with this condition will result in the cancellation and refund of the order.

Furthermore, it is specified that a legal entity that purchases one or more Tickets on behalf of its employees who have student status (on work-study or internship) will not be able to benefit from the reduced “student” rate.

 

ARTICLE 3 – Availability

Tickets go on sale in limited quantities. Sysdream informs the Client in real time about the availability of Tickets when ordering.

The ticket office for ordering Tickets to attend the Event’s conferences closes two (2) days before the Event start date. The ticketing system for ordering a training at the Event closes ten (10) days prior to the date of the Event.

 

ARTICLE 4 – Ordering the ticket(s)

4.1 Selecting the Ticket(s)

The Client selects the Ticket of its choice, in the desired quantity and within the limits of the Tickets available. For the processing of the order, the following information must be communicated: name, first name, position in a company, company of the Client, email address, country, and billing address. This personal information is processed by Sysdream under the conditions stipulated in Article 11 “PROTECTION OF PERSONAL DATA”.

The Client must also accept the T&Cs, by checking the box provided for this purpose when placing the order.

4.2 Ticket holder identification

The Client is required to identify the Holder by communicating to Sysdream the following information: name, surname, function in the company, company of the Client, country, and email address. This information is necessary to make the Ticket nominative. This information can be qualified as personal data and therefor are processed by Sysdream under the conditions stipulated in Article 11 “PROTECTION OF PERSONAL DATA”.

4.3 Order summary and payment

Clients are required to check the details of their order and correct any errors, before filling in their bank details.

Following this check, Clients are invited to proceed with the payment of their order.

 

ARTICLE 5 – Payment

The payment of the order is to be made exclusively in euros and by credit card. Only the following cards are accepted: CARTE BLEUE, VISA, MASTERCARD, AMERICAN EXPRESS and E-CARTE BLEUE.

The Client guarantees possessing the necessary authorizations to use the method of payment chosen during the validation of the order. The bank account used for the selected mode of payment will be debited with the amount of the order upon acceptance of the transaction by the payment center. In the event of refusal by the payment center, the order will be automatically cancelled.

Validation of the order by the Client implies the obligation to pay the total amount indicated.

 

ARTICLE 6 – Payment security

Payments made for the transactions conducted on the Site are secured through Stripe’s payment platform, which is certified for online banking payments. For more information, please review the Stripe Checkout associated documentation, available on the Stripe website.

 

ARTICLE 7 – Order confirmation and follow-up

A summary of the order information will be sent to the Client via an order confirmation email. The order will only be final upon receipt of this email.

In the event of failure of receipt of the confirmation email, the Client shall contact Sysdream at the following address: info@hackinparis.com.

 

ARTICLE 8 – Proof of the transaction

The Client is invited to save the proof of the transaction, which will appear on the screen after obtaining the agreement of the bank associated with the card used for the payment of the order.

The computerized registers kept in the computer systems of Sysdream or any of its service providers have, except in the case of an obvious error on the part of Sysdream or one of its service providers, probative force with regard to orders placed and the execution of the parties’ obligations. Orders and invoices are archived on a reliable and durable support as to correspond to a faithful copy as described in Article 1366 of the French Civil Code.

 

ARTICLE 9 – TERMS OF DELIVERY AND US OF TICKETS

9.1 Ticket delivery

The Ticket is sent to the Client as an attachment to the order’s confirmation email. The Client can then choose either to print the ticket or to present it on their smartphone at the entrance of the Event.

9.2 Ticket resale

Each Ticket is nominative and personal. In accordance with article L.313-6-2 of the French Criminal Code, it is prohibited to sell tickets for commercial or cultural events without the express authorization of the organizer or the owner of the event’s exploitation rights.

9.3 Fraudulent reproduction of Tickets

It is strictly prohibited to reproduce, duplicate or counterfeit a Ticket in any way whatsoever. Reproduction of a ticket is prohibited and would provide no benefit. Anyone who illegally reproduces a Ticket and/or uses a counterfeit ticket is liable to prosecution.

Sysdream reserves the right to verify the identity of the Ticket holder by asking the Ticket holder to show proof of identity, in order to ensure that it is the same person as the one whose name is on the Ticket.

9.4 Theft and loss of Tickets

Sysdream disclaims all responsibility in case of loss or theft of the Ticket(s), including at the Event site.

 

Article 10 – Cancellation, Reimbursement

10.1 Cancellation requested by the Client

10.1.1 For training sessions

For the training sessions all cancellations must be made in writing and sent to Sysdream within thirty (30) calendar days prior to the date of the training session. If the cancellation of the training session(s) occurs after this period, Sysdream will not be able to refund the amount paid by the Client for the cancelled training session(s).

10.1.2 Cancellation of one or more conferences, workshops and challenges

No cancellations can be made for all, or parts of the talks scheduled during the Event. The amount paid by the Client for the cancelled talks will not be refunded by Sysdream.

10.1.3 Cancellation by the Client in the event of a pandemic

Notwithstanding the foregoing, if the cancellation is requested due to the impossibility of travelling to the Event Venue because of measures taken by the French authorities (in particular due to a pandemic situation), Sysdream will make its best efforts to offer an alternative solution to the Client. In the absence of agreement between the two parties on the solution proposed by Sysdream, the Client shall be refunded for the amount paid by the latter for the talk concerned.

10.2 Cancellation of the Event by Sysdream

10.2.1 Cancellation of one or more conferences, workshops and challenges

In the event of the cancellation of one or more conferences, Sysdream shall inform the Client and offer a refund of the amount paid by the latter in proportion to the conferences, workshops and challenges that have been cancelled by Sysdream. No other compensation can be claimed due to this cancellation.

10.2.2 Cancellation of a training session

In the event of cancellation of a training session, Sysdream may offer the Client the opportunity to participate in another proposed training session or will refund the Client of the amount paid for the training in question. No other compensation can be claimed due to this cancellation.

10.3 Right of withdrawal

In accordance with Article L. 221-28 of the French Consumer Code, the purchase of a Ticket is not subject to the legal right of withdrawal. All validated and paid orders are firm and definitive.

 

Article 11 – Protection of personal data

Within the framework of this event, Sysdream is required to process personal data concerning the Client in accordance with the applicable rules and regulations.

In order to be informed of the processing of their personal data in this context and of the rights they have as a data subject, Clients are invited to consult the Site’s Privacy Policy, which is accessible at the bottom of each page of the Site.

 

Article 12 – Liability

Sysdream cannot be held liable:

–        In the event of the non-performance or poor performance of its obligations being attributable to the Client, to the act of a third party not acting in the name of and/or on behalf of Sysdream, or in the event of force majeure;

–        For any inconvenience or damage inherent in the use of the Internet, including, but not limited to, a breakdown in service, external intrusion or the presence of computer viruses;

–        Due to problems that may occur during the ordering, processing, downloading or printing of the Ticket attributable to the Client, to an act of a third party not acting in the name of and/or on behalf of Sysdream, or to a case of force majeure;

–        In the event of theft of, loss of or damage to personal property that may occur at the Event Venue.

 

Article 13 – Code of conduct of the event

The Client undertakes:

–        Not to share content that is unrelated to the Event, in particular, but not limited to, advertisements, videos or photos (whether or not of an illicit nature) during the Event, in particular when the latter takes place online;

–        Not to distribute any advertising material during the Event without the prior authorization of Sysdream, particularly when the Event involves physical attendance;

–        Not to use abusive, discriminatory, racist or defamatory language or commit any form of harassment towards another participant or speaker;

–        Not to damage the image of the Event, Sysdream and the speakers;

–        Not to interrupt the speakers or spam other participants;

–        Not to hack or attempt to hack the platform;

–        Not to copy or counterfeit, in particular, but not limited to, the course materials and the conference subjects;

–        To comply with the organizer’s instructions during the Event;
To respect the premises and the equipment made available to the Client;

–        To show respect for everyone’s opinions.

Any breach of any of the Client’s obligations will lead to the immediate exclusion of the Client from the Event.

If, during the Event, the Client witnesses or is the victim of an act that constitutes a violation of this Code of Conduct, the Client must immediately contact a member of the organization or send an email to the following address: info@hackinparis.com

 

Article 14 – Applicable law – Competent jurisdiction

The present T&Cs along with any order placed on the Site are governed by French law, except as otherwise provided. These T&Cs are available in English and French. In the event of any conflict or inconsistency between these two versions, the terms of the French version shall prevail.

Any dispute shall, failing amicable agreement, be subject to the exclusive jurisdiction of the French courts.
