When consulting and using this site (hereinafter referred to as “the Site”), all users (hereinafter referred to as “the User”) agree to respect the conditions hereinafter (the “GTU”).

Sysdream reserves itself the right to modify the GTU at any time, in whole or in part, in particular to adapt them to the technological, regulatory or legal environment. Therefore, the User is invited to regularly consult the GTU in order to be informed of any update.

1.      Intellectual property

Sysdream grants the User, free of charge, a personal, non-exclusive and non-transferable, right of access to this Site, for non-commercial use, for the duration of the use of the Site, in accordance with the following conditions.

The architecture of the Site, the trademarks, logos, graphics, designs, videos, interfaces, slogans, texts, databases, domain names, software, algorithms, source code and objects (including HTML), contents, without this list being exhaustive, and more generally all the elements composing the Site, all the rights, titles and interests relating thereto and the Site itself (hereinafter, the “Protected Elements”), are the exclusive property of Sysdream and/or relate to a license granted to Sysdream.

The present Terms of Use do not imply any transfer to the User of the intellectual property rights attached to the Website or the Protected Elements.

Any action likely to infringe, directly or indirectly, the intellectual property rights of Sysdream, or those of third parties on the Protected Elements, is strictly prohibited and the User agrees to respect this prohibition. Thus, any act of reproduction, transmission, commercialization or creation of derivative works (without this list being limitative) based on the Protected Elements without obtaining the prior written consent of Sysdream is strictly prohibited. Failure to comply with this prohibition may result in legal proceedings (notably for counterfeiting) against the User.

The creation of simple or deep hypertext links to the Site may only be made with the prior written authorization of Sysdream.

Sysdream reserves the right to delete any links proposed by its Website to a third party website. Hyperlinks are provided for information purposes only and Sysdream has no control over the content of the linked sites and cannot be held responsible for them (the pages remain the sole responsibility of their publisher). In the event that a hypertext link leads the User to access a page with offensive or illicit content, the User is invited to report this link to Sysdream before any other action is taken so that Sysdream can take all appropriate and timely measures to stop the disturbance. 2.      Downloadable content

Any document (including brochures, white papers, thematic files, information booklets, infographics, advice sheets) that can be downloaded by the User from the Site (hereinafter “Downloadable Content”) are exclusively intended for commercial purposes for prospects and/or customers.

The downloading of these documents may be conditional upon the provision of personal data by means of a form. In this case, the User is invited to refer to the Privacy Policy of the present site, which is accessible at the bottom of each page of the Site, in order to be informed of the manner in which personal data concerning him/her is processed in this context.

Hub One grants the User a non-exclusive right of reproduction, in electronic and/or paper format, in a single copy, for the entire world, of the Downloadable Content actually downloaded, on the strict condition that this reproduction contains Hub One’s reference (at least “Source: Hub One” as well as a redirection link to the Site). This right of reproduction is strictly personal.

Hub One does not grant any right to reuse, exploit, distribute or adapt the Downloadable Content for commercial purposes or on behalf of third parties. The Downloadable Content remains the property of Hub One.

Hub One reserves the right to modify or terminate the rights granted under this section at any time, in whole or in part, without entitling the User to any type of recourse against Hub One.


3.      Availability of the Site

Hub One will make its best efforts to maintain the Site accessible 7 days a week and 24 hours a day.

However, the User is informed that, in particular in the event of maintenance operations, migrations, updates or constraints related to the functioning of the Site or the Internet network, access to the Site may be temporarily suspended.

You are reminded that data transmission on the Internet is only relatively reliable. In addition, the networks on which the data circulate have different characteristics and capacities and are likely to be saturated at certain times of the day, which may affect the time taken to download the said data and their accessibility.


4.      Prohibited behaviors

The User agrees not to disrupt the proper functioning of the Site. As such, the behaviors listed below are prohibited (without this list being exhaustive) on this site:

–        Any fraudulent access or maintenance;

–        Any obstruction or alteration to the operation of the Site;

–        The introduction, deletion or modification of data;

–        The introduction of viruses;

–        Damage, illegal access or modification of stored data;

–        The use of a robot for the aspiration of data (“scrapping”), or more generally any other data collection tool with the aim of extracting or reusing a substantial part of the elements of content;

–        Accessing or attempting to access the Site by any means other than through the Site interface provided by Hub One.

Failure to comply with the provisions of this article may result in the User’s liability and, in some cases, in the imposition of criminal penalties.


5.      Responsibility

The information contained on the Site (in particular the texts, images, sounds and any other data) is non-contractual. In other words, it is provided as an indication without any guarantee, explicit or implicit, of validity, exhaustiveness or topicality, for the sole general information of the User. Thus, they cannot replace or substitute for offers or services of a technical or commercial nature or of any other professional nature.

When filling in a form on the Site, the User undertakes to provide only accurate, sincere and up-to-date information, and to provide his/her true identity. Furthermore, if the User is acting on behalf of a legal entity, he or she undertakes to be authorized to do so.

Hub One shall not be liable to the User or any third party for any direct or indirect damage resulting from (but not limited to) the use of the Site (e.g., loss of data, opportunities, reputation), the impossibility of accessing the Site, the use of elements contained on the Site (e.g., Downloadable Content), or any failure, error or interruption of the Site.

Hub One will use its best efforts to ensure the security of access to the Site.

Nevertheless, Hub One cannot guarantee absolute security. In this respect, Hub One shall not be held responsible for any malfunction or damage inherent in the use of the Internet, in particular for service interruptions, external intrusion, the presence of computer viruses, or computer security breaches that may cause damage to computer equipment and data.

The Protected Elements of the Site are intended for the only permitted purposes, stipulated in the present GTU. Thus, in the event of a claim by a third party concerning the violation of its intellectual property rights resulting from the use of a Protected Element or Downloadable Content by the User, for purposes other than those permitted by these GTC, Hub One shall in no case be held liable. In this case, the User expressly waives any and all recourse whatsoever against Hub One.

It is understood that Hub One is in no way responsible for the consequences resulting from the User’s violation of these GTU.


6.      Protection of personal data

In the context of this site, Hub One is required to process personal data concerning the User in accordance with the applicable regulations.

In order to be informed of the processing of personal data concerning him/her in this context and of the rights he/she has as a data subject, the User is invited to refer to the Site’s Privacy Policy, which can be accessed at the bottom of each page of the Site.


7.      Applicable law and jurisdiction

These GCU and the consequences of the use of the Site are governed by French law, regardless of the country from which the User accesses the Site.

These GTU are available in English and French. In the event of any conflict or inconsistency between these two versions, the terms of the French version shall prevail.
